Copyright & Rights Enforcement

Anamir operates in compliance with the Digital Millennium Copyright Act (DMCA) and responds to valid claims of copyright infringement involving content distributed through the platform. This document defines the platform's copyright enforcement procedures, DMCA notice requirements, counter-notification process, and repeat infringer policy.

Reporting Infringement

To file a copyright infringement claim, submit a written notice to Anamir's designated Copyright Agent. The notice must include:

1. A physical or electronic signature of a person authorized to act on behalf of the exclusive rights owner.
2. Identification of the copyrighted work claimed to be infringed, including registration number where available.
3. Identification of the infringing material and sufficient information to locate it on the platform (e.g., track URL, video URL, timestamp).
4. Your contact information: full name, address, telephone number, and email address.
5. A statement of good faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law.
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights owner.

Enforcement Process

Upon receipt of a valid DMCA notice:

1. Receipt will be acknowledged within 24–48 hours.
2. The claim and supporting materials will be reviewed.
3. If valid, the infringing content will be removed within 24–72 hours.
4. The account holder responsible for the upload will be notified of the removal and its grounds.
5. An enforcement record will be issued against the account.

Counter-Notification

An account holder whose content has been removed under a DMCA notice may file a counter-notification with the Copyright Agent. The counter-notice must include:

1. Your physical or electronic signature.
2. Identification of the removed material and its location prior to removal.
3. A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
4. Your name, address, and telephone number, and a statement consenting to jurisdiction of the federal court in your judicial district.
5. A statement that you will accept service of process from the original complainant or their designated agent.

Counter-notices must be submitted to: copyright@anamir.ai

Following receipt of a valid counter-notice:

1. The counter-notice will be forwarded to the original complainant.
2. If the complainant does not initiate legal proceedings within 10–14 business days, the content may be restored.
3. If legal proceedings are initiated, resolution will proceed through the appropriate court.

Repeat Infringer Policy

Anamir enforces a graduated enforcement framework for repeat copyright infringement:

• First Offense: Content removal and formal account notice.
• Second Offense: Content removal and temporary account suspension (7–30 days).
• Third Offense: Permanent account termination.

Enforcement actions may be appealed through the platform's support system where there is reasonable basis to believe an action was issued in error.

All released content receives a permanent Provenance ID (APID). Removed content retains its APID record to prevent re-upload fraud and preserve the integrity of the release infrastructure.

False Claims

Filing a knowingly false DMCA notice constitutes perjury under federal law (17 U.S.C. § 512(f)). Parties who misrepresent that content is infringing may be held liable for damages, including costs and attorneys' fees. Submit a DMCA notice only where you have a reasonable, good faith basis to believe the content infringes your rights.
